1. Personal information

“Personal information” in this case refers to personal information in the Act on the Protection of Personal Information (Act No. 57 of 2003, referred to the Personal Information Protection Act hereafter) and is defined as information relating to a living individual. It refers to names, telephone numbers, e-mail address, address and other information that can specifically identify a particular individual.

2. The acquisition and use of personal information

2.1

Tohshin group (Tohshin Corporation, Tohshin Seiki Corporation and Tohshin Technical Corporation) will acquire the user’s personal information, only in the scope that it will be used to conduct the following business activities.

① Personal information through sales activities.

The following personal information will be acquired through Tohshin group’s sales activities.

  1. The personal information that is used to provide our group’s products and services which may include the customer’s name, business location, bank account information for transferals, the name and contact information of the person in charge (phone number, email address etc.), department name, job title.
  2. The personal information contained in written documents and or electronic documents that are provided to our group through inquiry forms on our website, questionnaires and other sales activities.
  3. The personal information that is obtained from conversation, electronic correspondence, telephone inquiries and every other form of communication that occurs between the customer and the group.
② Personal information through procurement activities

The following personal information will be acquired through procurement activities.

  1. Personal information such as the name of customers ( purchasers, subcontractors, construction contractors etc.), business location, bank information, details of personnel, contact information( phone numbers, mail address etc.), department name and job title.
  2. The personal information that is obtained from conversation, electronic correspondence, telephone inquiries and every other form of communication that occurs between the customer and the group.
③ Personal information through recruitment activities

The following personal information will be acquired through recruitment activities

  1. The personal information that is obtained through recruitment activities for applicants applying to Tohshin group such as photographs, name, D.O.B, gender, residence, phone number, mail address, career(work history, school history ), written exams and aptitude exams.
  2. The personal information that is contained within written or electronic documents submitted to Tohshin group through our group’s homepage, job sites, company information sessions, job hunting events and other recruitment activities.

Apart from those mentioned above, when you use our site’s services, systems and web sites, technical data and or data usage regarding access, usage history browsing history, page viewing history, IP address and OS devices will automatically be acquired.

2.2

Tohshin Group will use the personal information for the following purposes. In addition, should the use of the personal information go beyond the scope outlined, consent will be obtained from the relevant party in a suitable way beforehand.

① Personal information through sales activities.
  1. To communicate with customers through face to face to visits, web meetings, phone calls, emails or various other communication methods. Some of the other methods include the following;

    • To make contact for customer visits and or appointment scheduling.
    • To send company and or service information guides.
    • To send questionnaires
    • For information guides relating to events and web contents etc.
  2. To ensure the safety and or security of visitors by regulating access to the premises.
  3. To manage the information of customers when conducting sales activities.
  4. To use the information for analysis to enhance and improve our business and sales activities and services.
② Personal information through procurement activities.
  1. To communicate or meet with the person in charge of the client through face-to-face visits, web conferencing, telephone, e-mail, or other methods.
    To conduct meetings or to execute contracts, inquiries, audits, requests for investigations, etc.
  2. To ensure the safety and or security of visitors by regulating access to the premises.
  3. To manage the information of customers when conducting procurement activities.
  4. To use the information for analysis to enhance and improve our business and sales activities and services.
③ Personal information through recruitment activities
  1. To provide information on or accept applications for company information sessions, etc.
  2. To select applicants for potential employment.
  3. To make contact with applicants (regarding interview scheduling, application results etc.)
  4. To provide basic data for employment management in making employment decisions.
  5. For other operations related to and or incidental to employment selection.

3. Managing and protection of personal information

We strictly manage personal information and will not disclose or provide personal information to any individuals or third parties without the consent of the relevant individual except in the stated cases as below. Moreover, for safety cosiderations, we will take preventative measures to prevent risks such as unauthorized access to personal information, loss, destruction, falsification and the leaking of personal information.

  • 3.1

    In the case where it is necessary to protect a person’s life, body and/or property, and it is difficult to obtain the individual’s consent.

  • 3.2

    In the case where there is an outsource of the handling of personal information to subcontractors, co-operating companies and affiliated companies where a confidentiality agreement exists and the relevant individual has been duly informed as such.

  • 3.3

    When the information is demanded in accordance with laws and regulations.

    When it is necessary to co-operate with national agencies that are conducting affairs stipulated by laws and regulations and obtaining consent of the person concerned will lead to the interference of said affairs being conducted.

4. Shared use

Tohshin group may share your personal information with other group companies or subcontractors as follows.

However, the scope of joint use is limited to the purposes of use (see Section 2.2), and will not be shared beyond the scope of such purposes.

Tohshin Group will not share personal information beyond the scope of the stated purpose of use. In addition, Tohshin Group will ensure that its subcontractors fully understand and comply with this Privacy Policy and will strive to prevent leakage of personal information from such subcontractors.

5. The disclosing of, correcting and suspension of use of personal information.

5.1

If a person requests the disclosure, correction, suspension of use, etc. (suspension or deletion, etc.) of his or her personal information in accordance with the provisions of the Personal Information Protection Law, Tohshin Group will respond to the request without delay.
(If the relevant personal information does not exist, we will notify you to that effect.)
However, please note that we will not be able to respond to requests for disclosure, correction, suspension of use, etc. in the following cases.

  • If that it cannot be confirmed that the relevant party is making the request.

  • If the reason provided by the relevant party for disclosure, correction and or suspension of use is something other than the personal information being untrue.

  • If disclosure, correction and or suspension of use is not necessary in light of the purpose of use (see Section 2.2)

  • If the relevant party identifies that the personal information is incorrect.

  • When there is no obligation to disclose correct and or suspend the use of information in accordance to the provisions of the related laws and regulations.

5.2

Upon receiving a request for disclosure, correction, and or suspension of use, from the relevant party, Tohshin group will conduct the necessary investigation without delay and based on the results, will disclose, correct, or suspend the use of the personal information followed by the notification to the relevant party to that effect. However, if the disclosure, correction and or suspension of use of personal information leads to a significant cost, or if it is difficult to disclose, correct, and or suspend the use of personal information, then we will take alternative measures as necessary to protect the rights and interests of the relevant party.

6.Consequences for not providing personal information

The provision of personal information by an individual in the course of Tohshin group’s business activities (see Section 2.1) is voluntary.
If you do not agree with this Privacy Policy and do not provide us with the personal information necessary for our business activities, we will not be able to respond to your request.

7. Privacy policy modification procedure

Tohshin Group will work on reviewing on improving its policy. Except as otherwise stated by law, the contents of this privacy policy are subject to change. Once the privacy policy has been revised, the policy will go into effect once users have been notified in a manner deemed acceptable by Tohshin Group, or when the policy is uploaded onto the company’s website.
